These Terms of Use govern your access to and use of Planticist, a plant identification, troubleshooting, and educational tool built by Technicole.
By using Planticist, you agree to these Terms.
Planticist Is an Educational Tool
Planticist helps users observe plants, explore possible plant identifications, and investigate possible causes of plant symptoms.
Plant identification and diagnosis can involve uncertainty. Different plant conditions may produce similar symptoms, and relevant environmental or biological factors may not be observable through the information provided to Planticist.
For this reason, Planticist may provide multiple possibilities, request additional observations, or conclude that there is insufficient information to reach a useful conclusion.
Planticist does not guarantee the identification of a plant, diagnosis of a plant condition, or success of any suggested action.
Information provided by Planticist is for informational and educational purposes.
Beta Status
Planticist is currently offered as a beta product.
During beta, features, plant coverage, diagnostic logic, identification logic, user interfaces, data structures, and availability may change.
You may encounter:
- Incomplete plant coverage
- Incorrect or incomplete results
- Bugs
- Unavailable features
- Changes to previously available functionality
- Temporary interruptions
Beta use and feedback help improve Planticist.
Plant Coverage
Planticist intentionally supports a curated plant and diagnostic library rather than claiming universal plant coverage.
A plant, cultivar, pest, disease, environmental condition, or other factor may not yet be represented in the Planticist knowledge system.
The absence of a possibility from Planticist results does not establish that the possibility is impossible.
User Accounts
Some Planticist features may require an account.
You are responsible for maintaining access to your account and for activity performed through it. You agree to provide accurate information where necessary and not to misuse another person's account.
Technicole may suspend or terminate access when reasonably necessary to protect Planticist, its users, or its systems from abuse or unauthorized activity.
Acceptable Use
You may use Planticist for lawful personal and educational purposes.
You may not intentionally:
- Attempt to gain unauthorized access to Planticist systems or another user's information
- Interfere with or disrupt the operation or security of the service
- Circumvent access controls or security mechanisms
- Use automated systems to excessively scrape, extract, or burden the service
- Introduce malicious code or attempt to exploit vulnerabilities
- Use Planticist in violation of applicable law
User-Provided Information
You are responsible for information you choose to submit to Planticist.
By submitting observations, plant information, feedback, or similar content, you give Technicole permission to process that information as necessary to provide, maintain, analyze, and improve Planticist.
Aggregated or de-identified information may be used to improve Planticist's plant knowledge, reasoning system, question design, and product experience.
Intellectual Property
Planticist, including its software, interface, branding, original content, knowledge-system structure, and other original materials, is owned by Technicole or used with appropriate permission.
These Terms do not transfer ownership of Planticist or its intellectual property to users.
You may use the service for its intended purposes, but you may not reproduce, redistribute, sell, reverse engineer, or commercially exploit substantial portions of Planticist except where permitted by applicable law or expressly authorized by Technicole.
Third-Party Services
Planticist relies on third-party infrastructure and services. Availability or functionality may occasionally be affected by those providers.
Technicole is not responsible for third-party services outside its reasonable control.
Availability and Changes
Technicole may modify, expand, restrict, suspend, or discontinue portions of Planticist at any time.
Because Planticist is in active beta development, no particular feature, plant record, diagnostic result, account feature, or level of availability is guaranteed to remain unchanged.
Disclaimer of Warranties
To the extent permitted by law, Planticist is provided "as is" and "as available" without warranties of any kind, express or implied.
Technicole does not warrant that Planticist will always be available, error-free, complete, or accurate, or that use of Planticist will produce a particular result for a plant.
Limitation of Liability
To the extent permitted by applicable law, Technicole will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of or inability to use Planticist.
This includes, without limitation, loss or damage involving plants, plant collections, property, data, or actions taken based on information provided through Planticist.
You remain responsible for decisions concerning the care, treatment, handling, propagation, purchase, disposal, or identification of your plants.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
Changes to These Terms
These Terms may be updated as Planticist evolves.
Continued use of Planticist after updated Terms become effective constitutes acceptance of the revised Terms where permitted by applicable law.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable law requires otherwise.
